Abstract

The research aims to noticfication of the Islamic legislation and to highlight the moral and human to maintaining the life creatures and the ambience in which we live and work to prevent the destruction of architecture from storage or used mass destruction weapon, and that dealings with goodness are non-assault of others is the most important Muslims characteristics, and the basis of Muslims relation with others is peace not war because that the war is not the destination or demand, Emitted on the fighting is not force or dispute in the creed but proceeded to push the evil, hence thay need to know that the rightful decision until the Muslims nation insight that the Zionist entity own these weapons. The study included an introduction and four chapters with conclusion,the first chapter is the definition of mass destruction weapons (nuclear, chemical, biological) types, effects and prevention, chapter II show the provisions of war, jihad and fighting etiquette at Islame and ownership or prohibition of possession these weapons at Sharia say the most correct to use, chapter iii are showing the conventions of ownership and used of these weapons at international law and treaties them to prevent of ownership or used therefore the International Criminal Court are looking at war crimes, chapter IV are showing the Qur'an miracles in international human law and comparison between Sharia and Law say the most correct, the study following inductive,descriptive and analysis methods. The study found a set of results need to get rid of these weapons by all states, otherwise Islamic States are entitled to possess these weapons obligation and use it encounter to hold out offensive attack against enemies armed forces only and not used against non-fighter items, The Islamic Sharia are superiority of all laws so that thay need to modify paragraphs of International Law with regard to the ownership weapons and remove the right of objection (Veto) of the Five Major Powers in accordance with the provisions of the Islamic Sharia who agreed with the first introduction on the Charter of the United Nations are Justice and Equality.
